Mike Brandt’s client hired Mike when he was being investigated for embezzlement from a former employer. The former employer alleged that Mike’s client had misappropriated over $40,000 in funds. Before his client was charged, Mike got involved in investigating the allegations and Mike and his client produced documentation showing there were valid explanations for many of the funds alleged to have been misappropriated. Based upon this information, the prosecutor agreed to charge a lower level felony which would eventually allow Mike’s client to have his record expunged (sealed). If the case had been charged as the more serious offense as was being alleged, Mike’s client would never have been eligible for an expungement and would have been stuck with a permanent record of this incident which would have haunted him for the rest of his life. As it turns out, Mike’s client was placed on probation for a few years, ordered to pay back a small portion of what he had allegedly taken, and was required to serve three weekends at the Workhouse. This result allowed Mike’s client to remain gainfully employed, not be subject to an extended period of incarceration away from his family, and also set the client up to be eligible for an expungement in the future.
