Mike Brandt represented a client who was originally charged with Domestic Assault for an incident occurring with her teenage daughter. The incident involved a scuffle between mom and daughter which was witnessed by a passerby who called the police. The police officer arrived, he interviewed the client’s daughter who told him that Mike’s client had pushed her and thrown her to the ground. Mike’s client adamantly denied doing this.
Mike argue to the prosecutor that the incident was not as the daughter had explained, and that any interaction between Mike’s client and her daughter was justifiable use of force to discipline the child pursuant to Minnesota law. The prosecutor agreed that the charges could be dismissed in one year as long as Mike’s client had no same or similar incidents.
The charges against Mike’s client were eventually dismissed, and Mike went back to court to have all the records sealed from this incident. This included all of the police records, court records, records obtained by the Minnesota Bureau of Criminal Apprehension, as well as any other state entities that had records from this incident. Mike successfully argued to the court that because the charges were dismissed, his client was entitled to have the records sealed. The court agreed and the court sealed all records from this incident.
