Mike Brandt’s client was driving his car after he had taken several prescription medications. Mike’s client ended up having a bad reaction to the medications and it significantly impacted his consciousness. Because of this, Mike’s client engaged in some erratic driving and eventually was involved in an accident. Based upon his physical characteristics as noted by the police who responded to the accident, the State charged Mike’s client with DWI for being impaired by the medications. In preparation of the case, Mike provided documentation to show that his client took the medication as prescribed, that his was a one-time incident, and that his client had taken significant steps to assure that an incident like this would not be repeated in the future. Based upon all that information, the prosecutor agreed to reduce the DWI charge to Careless Driving, Mike’s client paid a small fine, and was placed on probation for 1 year. This resolution kept a DWI off the client’s record and assured Mike’s client that he would not lose his license.
