Mike Brandt’s client was charged with a gross misdemeanor DWI after crashing his car into a neighbor’s wrought iron fence in the city of Andover, Anoka County. When the police arrived, they suspected that Mike’s client was under the influence of alcohol, they arrested him, and he tested at over twice the legal limit. Notwithstanding the complexities of the case, Mike convinced the prosecutor that there were issues with the testing device and he also pointed out that his client was very proactive in obtaining a chemical dependency assessment, attending the recommended class, and attending a MADD Victim Impact Panel. Based upon all of these factors, the prosecutor agreed to reduce the charges to a lower level—a misdemeanor. Mike was also able to convince the Judge to limit Mike’s client to one year of probation. In the end, Mike’s client paid a small fine and was placed on probation with no obligations other than to stay out of trouble for the one year.
