Mike’s client was charged with Gross Misdemeanor Domestic Assault after an altercation with his girlfriend. In preparing the case, Mike had his investigator contact the victim who had expressed that she wished to clarify some of the statements that she had made to the police about the incident, as well as her desire not to see Mike’s client prosecuted.
During this time, Mike encouraged his client to take proactive steps to address any anger management and chemical dependency issues that he may have. Based on Mike’s advice, Mike’s client attended and completed several programs.
In addition to having numerous discussions with the prosecutor about the case, Mike also discussed his client’s personal situation as well as the progress Mike’s client was making in his treatment programs. Mike put together a packet of information to present to both the prosecutor and the court that showed that Mike’s client was on a positive course and was taking the matter seriously.
Based upon the information provided by Mike through his investigator as well as the proactive steps Mike’s client had taken, the prosecutor agreed to reduce the charge to Misdemeanor Disorderly Conduct. The manner in which this case was resolved allowed Mike’s client to avoid serving any further jail time and avoid a conviction for assault.
