Mike Brandt’s client was charged with Domestic Assault for alleging entering into a drunken brawl with one of his roommates in November, 2014. The police responded to the client’s house and through a window observed Mike’s client allegedly assaulting one of his roommates. The police immediately arrested Mike’s client and charged him with two counts of Domestic Assault as well as Obstructing Legal Process.
In preparation of the case, Mike had his investigator take statements from several of the people who were present at the time of the incident, as well as the person that his client was alleged to have assaulted. These statements called into question the version of the incident that was given to the police. Because Mike was able to call the incident into question, the prosecutor agreed to enter into a negotiation whereby the matter was continued for dismissal – meaning that the matter was continued for a period of time after which the case will be dismissed as long as Mike’s client stays out of trouble.
