Mike Brandt’s client had his driving privileges revoked for a year due to an arrest for a DWI. Mike challenge the revocation of the driving privileges through a process called a Petition for Judicial Review. Mike argue that his client was illegally seized by the police when they accosted the client walking away from a parked car at a bar.
The state had the police officer testify that he suspected that Mike’s client was involved in a fight and also had engaged in suspicious driving behavior, had parked his car in a suspicious manner, and had walked away from his car. Mike argued that there was no reasonable suspicion that his client was engaged in any illegal activity and the judge agreed. The judge ruled that Mike’s client was illegally seized and suppressed all the evidence. Because all the evidence was suppressed, there was no test upon which his client’s driving privileges could be revoked and the revocation was rescinded (taken away).
