Rolling Re-test
There are a couple types of “failures” on an Ignition Interlock. One of them is failing a “rolling re-test.” A “rolling re-test” is where the Interlock requires you to re-test some minutes after you initially start the vehicle. If you do not submit the re-test, this is considered a failed re-test. If you miss three of these re-tests within a seven day period, you will get the following sanctions:
- 180 days added on for the 1st time this happens.
- 365 days added on for the 2nd time this happens.
- 18 months added on for the 3rd time this happens.
Many of us start our cars and let them warm up before we start driving. If you do this with Interlock, you could miss one of these “rolling re-tests.” With winter fast approaching, it is important to be aware if you are starting your car and warming it up.
Fails
If the Interlock device detects .02 or more of alcohol, and a re-test does not show below .02, this is a fail. If you have a “fail,” the sanctions can vary.
If your license has been canceled as inimical to public safety, any fails will result in a loss of Interlock privileges and a re-cancelation of your driving privileges.
However, if the Interlock was installed because of a revocation, a failure will only cause a sanction if the failure occurs within the last 90 days of the revocation period. In such a case, you do not necessarily “receive” more time, but you must have 90 days of “clean” blows before you can get off of Interlock. For example, if you blow “dirty” with 89 days to go, it would only add one day. However, if you blow “dirty” with one day to go, it would add 89 days.
