Mike Brandt’s client was charged with Domestic Assault for an incident occurring in the City of Lino Lakes, Anoka County, on August 27, 2018. As part of his representation, Mike thoroughly investigated the matter, took statements from various people regarding his client’s character, and had his client proactively start counseling.
The matter was scheduled for trial and on the day of trial, the prosecutor agreed to a negotiation whereby Mike’s client entered a plea of guilty to Disorderly Conduct for Engaging in Obscene Language. The Judge did not accept the plea, but stayed adjudication which means that Mike’s client was not convicted of this matter and was placed on probation for one year, but would be allowed to be discharged from probation once he completes 24 sessions of counseling. Mike also negotiated an agreement whereby the court records would be sealed (expunged) by agreement with the prosecutor without the need for a formal Petition. This means that once Mike’s client completes the counseling, these records will be sealed and his client will be able to say he had never been convicted of this matter and this offense will never show up on a background check.
