Michael Brandt’s client was charged with Domestic Assault for allegedly pushing his girlfriend down the stairs of their home and then throwing her onto her back. She claimed that she suffered bruises and other injuries from the incident.
In preparing the case, Brandt Kettwick Defense investigated the validity of the alleged victim’s story and found that she had a long history of violent behavior and numerous convictions on her record for assaultive and disorderly behavior. In preparation for trial, Mike provided the prosecutor with all of the information about the alleged victim, provided the prosecutor with the investigation conducted regarding the incident, and explained the client’s position. After reviewing all of this information, the prosecutor agreed to continue the matter for dismissal. This means that all charges will be dismissed as long as the client has no similar behavior in the next year.
This resolution was very important to Mike’s client because any conviction for Domestic Assault can result in a lifetime prohibition on the possession of firearms, along with other collateral consequences. Not only will the charge eventually be dismissed, but Mike’s client will also have the right to have the arrest records and court proceedings sealed so no one will discover the information on a background check.
