Mike Brandt’s client was charged with Domestic Assault for allegedly hitting his estranged wife in the face. In the beginning, the case looked very difficult because the alleged victim had numerous injuries and gave a very damning statement to the police claiming that Mike’s client had assaulted her. As part of the investigation of the case, Mike was able to get photographs taken by the alleged victim the night of the incident and through investigation was able to show that one of the photographs taken after Mike’s client had left showed worse injuries than a photograph taken an hour earlier. Our position was that the alleged victim had inflicted the injuries on herself.
Based upon Mike’s investigation, as well as other factors, Mike convinced the prosecutor to dismiss the charges against his client. A Domestic Assault charge carries with it a number of collateral consequences, including a lifetime ban on firearm possession, problems when seeking employment, and limitations on the activities that one can undertake with their children. A dismissal of the charges obviously avoided all of those problems for Mike’s client.
