Eric Bain’s client receives house arrest instead of jail time for stalking charge
Charge: Sentencing on Three Stalking Charges
Result: Mr. Bain was retained after his client had already pled guilty to three counts of Gross Misdemeanor Stalking, but before the sentencing hearing. Mr. Bain discovered that one counts was barred by double jeopardy. Prior to the sentencing hearing, Mr. Bain’s client was convicted of another similar offense with the same victim. At sentencing, Mr. Bain successfully argued for a disposition involving house arrest, instead of jail time as requested by the prosecutor.
