Mike Brant represented a client who was charged with felony Criminal Vehicular Operation arising out of an incident where the client failed to stop for a stop sign and was involved in a motor vehicle accident where the other driver received a broken bone, which made this a felony. Mike’s client tested extremely high with a blood alcohol concentration of 0.246.
Notwithstanding the terrible facts, Mike filed a motion to have the blood sample suppressed based upon a violation of his client’s Constitutional rights. Prior to the commencement of the hearing on whether or not the blood sample would be allowed at trial, the prosecutor agreed to drop the charge from a felony down to a gross misdemeanor. Mike’s client took advantage of that offer and resolved the case with a gross misdemeanor. Avoiding a felony conviction saved Mike’s client a lot of collateral consequences and other problems that could have cropped up in the future.
This resolution is the type of result that comes from the vigorous research, investigation, and diligence that Brandt Kettwick Defense brings to each of their cases.
