Felony Drug Charges Dismissed
Mike Brandt represented a client who was charged with felony Drug Possession for possessing cocaine. Mike’s client was accused of possessing cocaine after an undercover narcotics officer saw the client engage in a suspicious transaction outside a bar that was noted for drug activity.
In preparing the case, Mike brought a motion to suppress the evidence based upon an illegal seizure by the police. Mike conducted a contested hearing where he challenged whether or not the police possessed a reasonable articulable suspicion to accost his client. After the hearing, the Judge ruled that the police did not possess a reasonable suspicion of criminal activity and ruled that all the evidence recovered from Mike’s client would be suppressed. Because of this, the State dismissed the charges against Mike’s client.
