Mike Brandt’s client was charged with selling marijuana. This charge could have resulted in Mike’s client being convicted of a felony and losing numerous rights, including the right to ever possess a firearm for the rest of his life. Mike proactively had his client obtain a chemical evaluation, attend the recommended class, and Mike provided numerous letters of recommendation to the prosecutor showing the good character of Mike’s client.
Even though the charges started out as a sale of a controlled substance, Mike succeeded in negotiating the charge down to possession of a controlled substance and convinced the prosecutor to agree to a stay of adjudication. This means that no conviction would be entered on Mike’s client, and as long as Mike’s client completed his probation, the charges against Mike’s client would be dismissed. Mike’s client accepted the offer and was placed on probation for three years at which time the charges will be dismissed and Mike’s client would also be eligible to have the records from this incident sealed.
