Mike Brandt’s client was charged with gross misdemeanor DWI from an arrest that occurred in the City of Maple Grove, Hennepin County, on October 7, 2017. Mike’s client was stopped because she was driving without her headlights turned on and showed significant signs of impairment. At the police station, she tested at a 0.18 BAC—more than twice the legal limit. Because of the high test reading, Mike’s client was charged with a gross misdemeanor.
In evaluating the case and preparing it for hearing, Mike pointed out several things regarding the conduct of the police, the accuracy of the test, and also pointed out several proactive steps his client took prior to going to court. Based upon all of that, Mike was able to get the prosecutor to treat the charge as a misdemeanor which resulted in two years of probation and three days of Community Work Service. Having the charge reduced from a gross misdemeanor to a misdemeanor was very important to Mike’s client because of future job prospects and the impact a more serious charge would have on her record.
