Mike Brandt’s client was charged with a gross misdemeanor DWI after being arrested in the City of Fridley in March of 2018. After her arrest, she submitted to a breath test which revealed her alcohol content was over twice the legal limit. This caused her charges to be a gross misdemeanor which could result in up to a year in jail and/or a $3,000 fine.
In preparing the case, Mike pointed out to the prosecutor that the machine that his client tested on was not as accurate as they claimed and they might have issues with that at trial. Mike also pointed out that his client had been very proactive in obtaining a chemical dependency evaluation, completing the program that was recommended, and otherwise had a clean record. Based upon all of this information, the prosecuting attorney agreed to reduce the charge to a misdemeanor and Mike’s client was placed on one year of probation with the only condition that she not have any same or similar offenses.
