Nicole Kettwick’s client was charged with domestic assault in Lino Lakes after her boyfriend called the police and said that while they were out camping, she stormed in all upset and started yelling and pushing him around. After he tried to leave, she pushed him down and punched him in the face with a closed fist. Police observed a large scratch on his elbow and redness on his face. They determined domestic abuse took place and that she was the primary aggressor and she was arrested.
She was charged with Fifth Degree Domestic Assault – Intentionally Inflicts/Attempts to Inflict Bodily Harm, in violation of Minn. Stat. § 609.2242.1(2) a Misdemeanor with a maximum punishment of 90 days in jail and a $1,000.00 fine.
Nicole took a statement from her boyfriend and negotiated a favorable resolution for her client called a Stay of Adjudication on an amended charge. This means the Judge did not accept her plea and did not convict her. Meaning her plea will be held by the court, and after she successfully completes probation, the charge against her will be dismissed.
Nicole was able to accomplish her client’s goals of getting the charge amended, keeping a conviction off her record by getting a stay of adjudication and getting the No Contact Order vacated. Her client had to pay a minimal amount in fines and fees and was able to get her family back together.
