Nicole’s client came into our office with a letter that his driver’s license was suspended and he had no idea why. Nicole was able to find out that he was issued a ticket for speeding and no proof of insurance (a misdemeanor) and failed to appear at his court date or pay the fine. But there was one hitch — the police officer didn’t issue the ticket to him, but to his brother, who gave the client’s name, address, and date of birth to the police officer. Nicole got a judge to order DPS to remove the suspension of her client’s driving privileges and re-open the speeding and no proof of insurance case. Nicole conducted an investigation to prove her client was innocent; she compiled affidavits, photos, and other documents to show her client was not the driver. With only a week before the pretrial court date, the prosecutor agreed and dismissed all of the charges.
