Mike Brandt’s client was charged with Domestic Assault and Interference with an Emergency Call. The charges stemmed from an altercation with his estranged wife. Through the course of the case, Mike had his investigator contact several witnesses to attest to the character of his client, to cast doubt on the allegations made by the wife, and Mike’s client also completed some affirmative steps to show the prosecutor that he was taking the matter seriously.
Based upon all of these factors, the prosecutor agreed to enter into a negotiation whereby Mike’s client entered a plea of guilty to grabbing the phone from his wife’s hand while she was trying to call 9-1-1 (Interference with an Emergency Call), but the Court did not accept the plea and stayed adjudication of the matter—meaning Mike’s client will have no conviction on his record and will be eligible to have the case expunged (sealed) after two years. This was a case that started out with the risk of Mike’s client having a conviction for Domestic Assault, which could have resulted in probation for a number of years, losing his right to possess a firearm, as well as other collateral consequences. The manner in which the case was resolved will allow Mike’s client to effectively clean his record once the probationary period ends.
