Nicole’s client was charged with Domestic Assault and Disorderly Conduct in Zimmerman, Isanti County after getting into a fight with his wife.
Because the Court imposed a Domestic Assault No-Contact Order (DANCO) before Nicole was representing her client, she took a statement from the alleged victim and filed a Motion with the Court. The Court granted Nicole’s motion which allowed the two to have contact again. This allowed the family to stay in their home together while the case was pending (a six-month process), and a safety plan was created to prevent any arguments inadvertently escalating in the future.
Nicole encouraged her client’s participation in anger management programming, and this put her in a very strong position to negotiate a favorable resolution for her client. The Domestic Assault charge was dismissed, and the client received a stay of adjudication on the Disorderly Conduct Charge. What this means is, the court does not accept his plea, and so long as he stays law abiding, finishes his anger-management programming, and reimburses the prosecution for costs, the charge will be dismissed after one year and he will not have a conviction on his record.
