Mike Brandt’s client, who is an aspiring teacher, was out one night and engaged in some raucous behavior during a night of partying. Mike’s client was arrested and was charged with a misdemeanor Trespassing. Because of the background check that she would be facing in the future as she applied for teaching jobs, a charge like that on her record could keep her from gainful employment. In preparing the case, Mike had his client obtain a chemical use assessment to show that she did not have a problem with alcohol, Mike got copies of her school transcripts and also obtained letters of support from people demonstrating how this one night’s behavior was completely out of character for his client. Based upon all of that information, the prosecutor agreed to continue the matter for dismissal for three months. This means that the charges against Mike’s client will be dismissed in 90 days without any plea or conviction. The prosecutor also agreed to expunge (seal) the record once the charge was dismissed. This will allow Mike’s client to maintain a clean record.
